Who is Eligible for Small Group Coverage?
According to California law AB1672, small employers are guaranteed group coverage should they choose to purchase it, regardless of the employees' health status. A "small group employer" is defined as a business with 2 to 50 full-time employees. Owners are generally counted as employees, so sole proprietorships with one employee fall into this category, as do partnerships without any employees (by definition partnerships have two or more partners).
California state law AB1672 says that small employers cannot be denied coverage as long as they:

Who’s Eligible?
• W-2 paid full time employees working 30 or more hours per week
• W-2 paid part time employees working 20-29 hours per week. (Note: The employer does not have to offer coverage to part time employees, it is optional.)
• In certain case 1099 contract employees may also be eligible.
• Family members and dependents of enrolled employee are eligible for group health benefits. (Note: employer is not responsible for additional family members and dependents premiums.)

For husbands and wives sole proprietorships it can sometimes be difficult to obtain small group coverage. Not all California Group Health Insurance carriers will cover them as a small group. A few select carriers will offer coverage if proper documentation is supplied.
• A schedule C tax return with both husbands and wives name list
• A current business license with both names listed
• A detailed census must be presented. (Census forum provided by Fresno Health Insurance Services)
